Mattress Firm, Inc. (“Mattress Firm”, “we”, “our”, or “us”) is the employer of all full and part-time employees that work for Mattress Firm and its brands, including Sleep Experts and Sleep.com. If you apply to work at Mattress Firm or for any of its brands such as Sleep.com or Sleep Experts, Mattress Firm, Inc. is the employer of record. By providing your personal information to Mattress Firm, you expressly consent to the use of such information as described in this Privacy Notice. We may change or add to this Privacy Notice, so we encourage you to view it periodically. This Privacy Notice is made available to you for information purposes only and is not a contract between you and Mattress Firm.
What is Not Covered by this Privacy Notice?
We make a variety of discounts and other benefits available to our employees, which are paid for by us but offered solely by third parties. To receive these benefits, you may have to provide your personal information directly to these third parties. These third parties have their own privacy policies, which we encourage you to review before you submit your personal information. For example, we pay for a voter registration resource for our employees. To use this resource, you need to register directly with the third-party provider, which would then collect personal information from you in accordance with its own Privacy Notice. We do not receive any personal information about you from the provider of this benefit. You should contact these third parties directly for information on their privacy policies and for detail on how they use your personal information.
This Privacy Notice does not cover personal information that is protected by the Health Insurance Portability and Accountability Act of 1996 (HIPAA). All privacy policies relating to healthcare plans that we sponsor are given to you separately.
We do not employ persons younger than 18 years of age and as such, we do not knowingly collect personal information from persons under 18 years of age.

During the past year, we may have collected the following information about you. We may collect the following information about you:
- Identifiers, such as your name, email address, signature, address information, financial information, social security number and other information necessary for your employment with us. We may disclose this information to our Service Providers and Government Regulators.
- Characteristics of protected classifications, such as your gender, race, ethnicity, age and other information to help provide a diverse working environment. We may disclose this information to our Service Providers and Government Regulators.
- Professional or employment related information, such as hire date, salary information, job title, professional certifications and other information related to assessing your viability as a job applicant. We may disclose this information to our Service Providers and Government Regulators.
- Education information, such as your education level and other educational information necessary for your employment. We may disclose this information to our Service Providers.
- Criminal history and drug use, we may collect information related to your criminal background and drug use, and related information to ensure compliance with Mattress Firm policies. We may disclose this information to our Service Providers and Government Regulators.
- Internet or other electronic network activity, such as browsing time, browsing history, search history, and information regarding your interaction with an internet web site or application. We may disclose this information to our Service Providers.
- Geolocation data, including precise geolocation data in certain circumstances. We may disclose this information to our Service Providers.
- Related-party information, information about your spouse, siblings, and dependents and other information necessary to provide benefits and ensure compliance with Mattress Firm Policies. We may disclose this information to our Service Providers and Government Regulators.
- Audio, electric, visual, or similar information, such as recordings of telephone and conference calls and video interviews and on-site video recordings. We may disclose this information to our Service Providers.
We may additionally disclose the above categories of information when required to do so by law.
Some of the above information may be Sensitive Personal Information, such as your race/ethnic origin, disability status and precise geographic location. We use Sensitive Personal Information for legitimate business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share any Sensitive Personal Information.

How Do We Disclose Your Information?
During the past year, we may have disclosed information that we have collected about you as described below. We may disclose information that we collect about you for our business purposes and as legally required or permitted.
- With our Service Providers.
We may disclose information that we collect about you to companies that provide us with services in support of our ongoing human resource administration and management efforts. For example, we may disclose your information to the company that calculates sales commissions on our behalf. We may also disclose information about you to payroll processors, third-party benefits administrators, technical service vendors, companies that conduct surveys on our behalf, background check providers, consultants and attorneys. These providers must agree to appropriate restrictions on the protection and use of your personal information.
- With our Suppliers.
We may disclose your information to suppliers that participate in Mattress Madness, a program that allows our employees to purchase merchandise at discounted prices. We may disclose your information so that the participating suppliers can identify you as a Mattress Firm employee eligible to participate in the Mattress Madness promotion.
- With Government Authorities.
We may disclose your information as required or requested by a governmental agency (e.g., to respond to court order, subpoena or wage garnishment and report payments to applicable taxing authorities).
- With Law Enforcement and Collection Agencies
We may disclose your personal information as we believe to be necessary or appropriate: (i) under applicable law, which may include laws outside your country of residence; (ii) to comply with the request of a law enforcement or regulatory agency (including agencies outside your country of residence) or other legal process; (iii) to protect our operations or those of any of the Affiliated Entities; (iv) to protect the rights, privacy, property, interests or safety of Mattress Firm, the Affiliated Entities, Services visitors, customers, business partners, employees or the public; (v) to permit us to pursue available remedies or limit the damages that we may sustain; (vi) to enforce our Terms of Use; or (vii) to respond to an emergency.
- With Strategic Business Partners.
As we continue to develop our business, we or our affiliates may sell or buy other businesses or entities. In such transactions, your information may be one of the transferred business assets.
- At Your Direction.
We may disclose your information as requested by you.
Your California Privacy Rights
If you are a California resident, you may have the following rights with respect to the personal information we process about you:
- Right to Know. You may have the right to request information about the categories of personal information we have collected about you, the categories of sources from which we collected the personal information, the purposes for collecting, selling, or sharing the personal information, and the categories of third parties with whom we have disclosed your personal information, and the specific pieces of personal information we have collected about you.
- Right to Delete. You may have the right to request that we delete personal information that we have collected from you.
- Right to Correct. You may have the right to request that we correct inaccurate personal information that we maintain about you.
- Right to Non-Discrimination. Should you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand certain features of our website may not be available to you.
In addition to the rights above, California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we disclosed personal information in the immediately preceding calendar year. Exercising Your California Privacy Rights

You can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable law.
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.
We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.
